By Gabriel Giner, Editor  ·  Reviewed 2026-05-29  ·  CLR Editorial Review Desk

Delaware has no specialty state license for painting contractors but does require every contractor — painters included — to hold a Delaware Business License issued by the Division of Revenue under 30 Del.C. §2501. Non-resident contractors must also post a bond of 6% of the contract price (minimum $20,000) before beginning any Delaware project under 30 Del.C. §2502. The federal EPA Lead Renovation, Repair and Painting (RRP) Rule applies for any pre-1978 housing or child-occupied facility.

Federal requirement: EPA Lead RRP Rule

The federal EPA Lead RRP Rule applies in every state — including Delaware — to renovation, repair, or painting that disturbs paint in housing built before 1978. See our complete EPA RRP Lead Certification guide for who needs firm and renovator certification, what it costs, and how renewal works.

Regulatory Body Profile

Delaware Division of Professional Regulation (DPR) is the statutory authority responsible for issuing and enforcing this license under Delaware Code Title 24 (Professions and Occupations); Title 30 (Business License, Division of Revenue). The Delaware Division of Professional Regulation administers the trade licensing boards for electricians, plumbers, HVACR, and master pipefitters. Delaware does not issue a state general contractor license — any person doing contracting work in Delaware must instead hold a Delaware Business License from the Division of Revenue.

Out-of-State Reciprocity

For this classification, Delaware does not recognize the NASCLA Accredited Examination.

Reciprocal State Accepted Exam Conditions
No formal bilateral reciprocity agreements identified.

Not applicable — the Delaware business license is not a trade credential and does not reciprocate with other state licenses.

The Application Roadmap

  1. Form business entity. Register LLC/corporation with the Delaware Division of Corporations; Delaware is commonly used as the state of formation regardless of operating state.
  2. Apply for a Delaware Business License (Contractor). File with the Division of Revenue; $75 first year plus $75 per location. Annual gross receipts tax applies.
  3. Post the non-resident contractor bond if applicable. Non-residents post 6% of contract price, minimum $20,000, before work begins.
  4. Procure general liability and workers compensation. $1M/$2M GL is the practical floor; workers comp mandatory at one employee.
  5. Complete EPA Lead-Safe Firm Certification. Required for pre-1978 housing under 40 CFR Part 745.
  6. Register with local municipalities if required. Wilmington, Dover, and Newark may require a separate local business license.
  7. File the Delaware Gross Receipts Tax monthly or quarterly. Contractor rate is 0.6472% as of 2026; no sales tax in Delaware but gross receipts apply.
  8. Renew the business license annually by December 31. Division of Revenue issues renewal notices.

Where Applications Stall

The following pitfalls summarize the issues most likely to delay, return, or derail a Delaware Painting application based on the published board instructions and source materials cited on this page.

Skipping the non-resident bond

Non-resident painters who start work before posting the 6% bond face immediate back-tax assessment and inability to collect final payment.

Forgetting Gross Receipts Tax filings

Contractors frequently confuse the absence of sales tax with no tax at all. Gross Receipts Tax returns are due monthly or quarterly and compound penalties accrue on late filings.

Ignoring the federal EPA Lead RRP rule

Delaware has a substantial pre-1978 housing stock; EPA enforcement is active.

No workers compensation coverage

Delaware requires coverage from the first employee.

Overspray claims without GL

Overspray on coastal vehicles and landscaping is a common Delaware claim; $1M GL is the floor.
