Delaware Fire Sprinkler License Requirements (2026)

By Gabriel Giner, Editor  ·  Reviewed 2026-04-17  ·  CLR Editorial Review Desk

The Delaware Office of the State Fire Marshal (OSFM) licenses every company and every individual who designs, installs, tests, inspects, or maintains fire protection systems in Delaware under the Delaware State Fire Prevention Regulations (16 Del. Admin. Code 700). Both the company and the responsible individual must hold a license. Delaware requires NICET certification (typically Water-Based Systems Layout Level II for fitters and Level III for designers) plus a Delaware-specific written exam covering the State Fire Prevention Regulations. Effective January 1, 2026 the OSFM fee schedule increased and the State Fire Prevention Regulations were updated; applicants must reference the new edition.

Governing Authority

Delaware Division of Professional Regulation (DPR) administers and enforces this credential under the authority of Delaware Code Title 24 (Professions and Occupations); Title 30 (Business License, Division of Revenue). The Delaware Division of Professional Regulation administers the trade licensing boards for electricians, plumbers, HVACR, and master pipefitters. Delaware does not issue a state general contractor license — any person doing contracting work in Delaware must instead hold a Delaware Business License from the Division of Revenue.

Eligibility Requirements

At a minimum the applicant has to be 18 years old and supply a valid Social Security Number. No Delaware residency requirement. Out-of-state companies must register with the Delaware Division of Corporations.

Good moral character

OSFM reviews each individual license applicant for fitness, including disclosure of any prior fire protection license discipline.

Background investigation

Mandatory disclosure of criminal history.

Experience & Education Matrix

Eligibility here is not measured in years of experience but by Delaware does not impose a separate years requirement at the application stage — the NICET certification (which itself requires multi-year qualifying experience) is the proxy for technical competence, per the cited materials.

Accepted proof of experience or eligibility

  • NICET Water-Based Systems Layout Level II (fitter) or Level III (designer / RME) certification card
  • Resume describing past fire protection projects

Education substitution

A B.S. in Fire Protection Engineering may substitute at OSFM reviewer discretion.

Examination Structure

The licensing examination is delivered by Delaware Office of the State Fire Marshal (in-house written exam on the current Delaware State Fire Prevention Regulations). All of the following parts must be cleared prior to issuance:

  • Delaware State Fire Prevention Regulations examination — Delaware-specific rules, NFPA 13, 13R, 13D, NFPA 25, hydraulics75 questions, 180 minutes, passing score 70%

Examination fee: OSFM examination fee. Effective January 1, 2026 fees increased per the OSFM 2026 fee schedule.

Retake policy: Failed exams may be re-taken with a new fee at the next scheduled OSFM exam date.

Insurance & Financial Security

The cited materials impose no contractor license bond for this credential. Bear in mind that specific contracts, permits, or public works can still require their own bonds.

General liability

OSFM requires general liability insurance for licensed companies. $1,000,000 per occurrence is the practical floor.

Workers' compensation

Workers' compensation insurance is mandatory in Delaware for any employer with one or more employees under 19 Del. C. §2304.

Additional financial requirements

No state-level financial statement requirement.

Application and License Fees

Fee Amount
Application (non-refundable)$200
Examination$100
Initial license$250
Renewal (every year)$250

Maintenance & Renewal

Expect to renew the Delaware Fire Protection Systems Contractor / Individual License (Office of the State Fire Marshal) every year. Renewal currently costs $250. Both company and individual licenses renew annually. The 2026 fee schedule applies to all renewals submitted on or after January 1, 2026.

Continuing education: OSFM requires continuing education on current NFPA standards each renewal cycle. The NICET certification must also remain current.

Reciprocity and Endorsement

Delaware does not accept the NASCLA Accredited Examination for this classification.

Reciprocal State Accepted Exam Conditions
No formal bilateral reciprocity agreements identified.

Delaware does not formally reciprocate fire sprinkler licenses, but because the technical credential is NICET, an experienced out-of-state holder typically only needs to pass the Delaware State Fire Prevention Regulations exam. The NICET certification itself is portable.

Step-by-Step Application Roadmap

  1. Earn NICET Water-Based Systems Layout certification. Level II for fitters; Level III for designers and Responsible Managing Employees.
  2. Register the company with the Delaware Division of Corporations. Out-of-state companies must register and appoint a registered agent.
  3. Submit the OSFM company and individual license applications. File both applications together with NICET certificates, insurance certificates, and the application fees per the 2026 fee schedule.
  4. Pass the Delaware State Fire Prevention Regulations exam. Score 70%+ on the in-house OSFM exam covering Delaware-specific rules and NFPA 13/13R/13D.
  5. Receive both the company and individual licenses. OSFM issues both licenses after exam pass and document review. Both must remain active for the company to operate.
  6. Submit project plans for OSFM plan review. Delaware OSFM performs centralized plan review for fire protection systems statewide. Approval is required before installation.
  7. Schedule final acceptance testing with OSFM. OSFM-witnessed acceptance testing per NFPA 13 chapter 25 is required before occupancy.

Common Filing Mistakes

Drawn from the board instructions and sources cited on this page, the pitfalls below are the ones most likely to slow down or sink a Delaware Fire Sprinkler application.

Holding only the company license

Delaware OSFM requires both company and individual licenses. A company license alone does not authorize fire protection work.

Studying the old State Fire Prevention Regulations

The Delaware State Fire Prevention Regulations were updated effective January 1, 2026. Studying the prior edition is the most common reason candidates fail the OSFM exam.

Skipping centralized OSFM plan review

Unlike most states, Delaware OSFM performs centralized plan review. Skipping it and going directly to local building permits triggers a stop work order.

Missing the 2026 fee schedule increase

Effective January 1, 2026 OSFM fees increased. Submitting the prior fee causes application kickback.

Letting NICET lapse

A lapsed NICET certificate immediately suspends the Delaware individual license because the technical credential requirement is no longer satisfied.
