Montana Landscaping License Requirements (2026)

Gabriel Giner

By Gabriel Giner, Editor  ·  Reviewed 2026-04-14  ·  CLR Editorial Review Desk

Montana does not issue a state-level landscape contractor trade license. Every landscape business with employees must register with the Montana Department of Labor and Industry (DLI), and any sole proprietor working without workers compensation must obtain an Independent Contractor Exemption Certificate (ICEC) under MCA §39-71-417. Any commercial application of pesticides additionally requires a Commercial Applicator license from the Montana Department of Agriculture (MDOA) Pesticide Section under MCA Title 80 Chapter 8. Stream and ditch crossings on landscape projects require a 310 Permit under the Montana Natural Streambed and Land Preservation Act (MCA §75-7-101).

Regulatory Oversight

Montana Department of Labor and Industry — Business Standards Division (MT DLI) administers and enforces this credential under the authority of Montana Code Annotated Title 37 (Professions and Occupations) and Title 39 Chapter 9 (Independent Contractor Central Unit). The Montana Department of Labor and Industry administers the Construction Contractor Registration program, the Independent Contractor Exemption Certificate, and houses the State Electrical Board and Board of Plumbers that license individual electricians and plumbers statewide.
