By Gabriel Giner, Editor  ·  Reviewed 2026-05-06  ·  CLR Editorial Review Desk

Florida statute §489.103(7) explicitly exempts landscape contracting from state contractor licensure when work is limited to grading, planting, sod, irrigation tied to a non-potable source, and incidental hardscape under $25,000. Florida does NOT issue a state landscape contractor license. The relevant credentials are: (1) any application of pesticides or herbicides for hire requires a Limited Commercial Landscape Maintenance certification or full Commercial Pesticide Applicator license from the Florida Department of Agriculture and Consumer Services (FDACS) under Chapter 482 (Structural Pest Control) or Chapter 487 (Pesticide Regulation); (2) any irrigation contractor performing work that ties into a potable supply must hold a county irrigation contractor license (Florida has no state irrigation contractor license); (3) every county and most cities require a Business Tax Receipt (BTR); and (4) the FNGLA Certified Landscape Contractor (CLC) is a voluntary credential widely required by HOAs and commercial property managers.

The Licensing Authority

Licensing for this trade is governed by Florida Department of Agriculture and Consumer Services (pesticide licensing) and Florida Nursery, Growers and Landscape Association (voluntary CLC) (FDACS / FNGLA), the agency that issues and regulates the credential under Florida Statutes Chapter 482 (Pest Control), Chapter 487 (Pesticide Regulation), §489.103(7) (landscape exemption). FDACS licenses commercial pesticide applicators and Limited Commercial Landscape Maintenance personnel statewide. FNGLA administers the voluntary CLC professional credential. Counties and cities issue local business tax receipts and county-level irrigation contractor licenses.

Common Application Pitfalls

The following pitfalls summarize the issues most likely to delay, return, or derail a Florida Landscaping application based on the published board instructions and source materials cited on this page.

Skipping the county BTR

Florida Statutes §205 requires every business to obtain a county-level Business Tax Receipt; unregistered operation triggers fines and back taxes.

Spraying without FDACS certification

FDACS imposes civil penalties up to $10,000 per violation under §487.175. The Limited Certification is not optional for any spraying for hire.

Operating irrigation without county license

Most populous Florida counties require their own irrigation contractor license. Tying into potable water without one triggers cease-and-desist from the county building department.

Misunderstanding §489.103(7)

The landscape exemption only applies when the project does not involve structural work, roofing, electrical, or plumbing beyond non-potable irrigation. Stepping outside the exemption requires a Certified or Registered Contractor license.

Workers comp on construction work

Florida treats hardscape installation as construction; the workers comp threshold drops to one employee for any construction-related landscape activity.

Answers to Common Questions

Does Florida require a state landscape contractor license?

No. Florida Statutes §489.103(7) explicitly exempts landscape contracting from state contractor licensure. Licensing is local (county BTR) plus state pesticide certification through FDACS.

What is the Limited Commercial Landscape Maintenance certification?

A FDACS credential allowing application of fertilizer, herbicide, and a limited list of pesticides on landscape ornamentals and turf at residential and commercial properties. Requires the UF/IFAS Green Industries BMP training, the Core exam, the Limited L&O exam, and $300,000 liability insurance.

Do I need an irrigation contractor license?

Florida has no state irrigation contractor license, but most counties (Miami-Dade, Broward, Orange, Hillsborough, Pinellas) require a county-issued irrigation contractor license for any work that ties into a potable water supply.

Is FNGLA CLC mandatory?

No. FNGLA Certified Landscape Contractor is a voluntary professional credential, but it is widely required by HOAs and commercial property managers to bid premium contracts.

How often does the FDACS Limited Certification renew?
